Conditions

THIS PERMIT IS SUBJECT TO THE FOLLOWING CONDITIONS AND TO ANY SUPPLEMENTARY CONDITIONS DEEMED NECESSARY BY THE DIRECTOR OF PUBLIC WORKS AT THE TIME OF ISSUANCE

1. The applicaton must be submitted to the Town at least one (1) week prior to the start date. Please ensure accurate informaton is provided and the Certficate of Insurance conforms to the Town of Lincoln requirements listed below to avoid processing delays.

2. This permit is not valid:
a. On MTO highways or Regional roads
b. On roads or structures otherwise restricted by Municipal By-Law.

3. The use of any road or structure may be restricted by the Corporation of the Town of Lincoln at any time, without prior notice.

4. Notwithstanding the issuance of this permit, and where applicable, the carrier is subject to all applicable laws and regulations within the Province of Ontario.

5. The permit may be withdrawn upon written notice at any time by the Town.

6. The original of this permit must be carried in the vehicle and produced upon demand of a police officer or an officer appointed for carrying out the provisions of the Highway Traffic Act.

7. Where a permit is issued in respect of:
a. HEIGHT: The load shall not be composed of articles loaded one on top of the other.
b. WIDTH: The load shall not be composed of articles loaded by side or crosswise.
c. LENGTH: The load shall not be composed of articles one behind the other and any overhang to the rear shall not exceed 4.6 meters from the center of the rear most axle.
d. WEIGHT:
i) The load shall not be composed of more than one (1) article.
ii) Bridge postings and half load restrictions pursuant to Part VII of the Highway Traffic Act apply.

8. Vehicles and loads in excess of the width and/or length prescribed under Section 109 of the Highway Traffic Act shall be marked with four (4) or more flags, one as near as practicable to each corner of the vehicle or load. The flags shall be at the rear of the vehicle or load, they shall be not less than 2 meters above the highway surface. Where a vehicle or load is wider at any point or points on either side than at the corner, it shall, where practicable, be so marked with such a flag at the widest point on each side.

9. Vehicles and loads in excess of the length prescribed under Section 109 of the Highway Traffic Act shall in addition to the flags required under Condition B, display on the rear, in a clearly visible position, a sign bearing the words "LONG LOAD" in black letters at least 200mm high with lines forming the letters at least 30mm wide on a yellow background.

10. Where a permit is issued on condition the permit holder provide escort protection, the escort vehicles shall proceed the vehicle and load on a two lane road or follow the vehicle and load on a four lane road at a distance of 150 metres bearing a sign reading "CAUTION OVERSIZE LOAD FOLLOWS" or "CAUTION OVERSIZE LOAD AHEAD" as the case may be in black letters at least 200mm high with lines forming the letters at least 30mm wide on a yellow background.

11. The Corporation of the Town of Lincoln reserves the right to require the applicant to provide police escorts.

12. The carrier agrees and accepts that should any portion of the route deemed unsafe and substandard due to the oversized load, at the sole discretion of the Director of Public Works, the security deposit may be used without notice, to complete repairs and/or restoration as deemed necessary.

13. It is the carriers responsibility to contact the Public Works Department to request the inspection of their permit for release of funds.


INSURANCE REQUIREMENTS
During the period that’s being requested, the carrier shall keep and maintain insurance coverage as outlined below, provided by (an) insurance company(ies) licensed to transact business in the Province of Ontario, and of satisfactory financial standing to the Corporation of the Town of Lincoln.
  • Commercial general liability insurance in the minimum amount of two million dollars ($2,000,000) inclusive per occurrence. Coverage shall include but not limited to bodily injury including death, damage to property including loss of use thereof, personal injury, premises and operations liability, tenant legal liability and shall contain a cross liability, severability of insured clause. Such policy shall be endorsed to protect the Corporation of the Town of Lincoln as an additional insured as the owner of the highway against all liability but only respect to the construction of the Applicant.
  • The carrier must provide an insurance certificate to the satisfaction of the Town that confirms the Town’s requirements stated above, if requested by the Town the carrier is to provide a certified true copy of the policy certified by an authorized representative of the insurer.
  • The policy shall be endorsed to provide the Town with not less than thirty (30) days written note of cancellation. If the policy is cancelled for any reason or if the permit holder fails to confirm that insurance coverage is always in place the permit holders permit will be considered invalid.

INDEMNIFICATION
The carrier agrees to accept and indemnify The Corporation of the Town of Lincoln from any action, claim, injuries, damage or loss whatsoever, arising from the operation carried out under the approved permit.  
 

Fees

OVERSIZE PERMIT (2025)

FEE CONDITIONS

The carrier understands that no amounts will be refunded if the carrier has any outstanding amounts due to the Town including taxes, utilities or other. The Town has the rights to offset against any amounts due before issuing a refund if applicable.

The carrier agrees and accepts that should any damage be caused by the works, at the sole discretion of the Director of Public Works, the security deposit may be used without notice, to complete repairs as deemed necessary.

It is the carrier’s responsibility to contact the Public Works Department to request the release of their deposit.

I acknowledge that I have read this application form in full and that I understand, accept and agree to all conditions and requirements, should a permit be approved and issued. A copy of the approved permit must be carried in the vehicle at all times.
