Screenings and Hearings

• Step 1

  The first step to dispute a penalty notice (ticket) is by booking a screening with a screening officer at the Town of Lincoln by:

  • Completing an online Screening Request Form or;
  • Visiting the Municipal Law Enforcement Department in person at 4317 Central Avenue, Beamsville (the former Beamsville District Secondary School).
  • To make application for screening, you must provide the Penalty Notice Number.
  • For Parking Related Matters: Request for Dispute known as “Request for Screening” must be received within 15 days of issuance of penalty notice date as indicated within the issued Penalty Notice.
  • For Non-Parking Related Matters: Request for Dispute known as “Request for Screening” must be received within 30 days of date of issuance as indicated within the issued Penalty Notice.

  *Please note: failure to attend at the scheduled in-person screening date/time will result in an additional non-appearance fee and the screening will take place in absentia.

• Step 2

  Once a screening request has been received and processed, based on the appellant’s election, the screening will take place (written or in-person).

  * Requested in-person screenings are conducted at 4317 Central Avenue, Beamsville (the former Beamsville District Secondary School) on Thursdays as assigned.

• Screening Process

  The Screening Officer will:

  • review all information provided by you (the appellant) for consideration (dispute allegation of contravention or provide extenuating circumstance i.e. emergency/hardship).
  • review the offence notice.
  • review the evidence of the issuing officer, including notes and photographs.
  • review the pertinent by-law and provision.

  *Upon completion of the above, the Screening Officer will take all information in its totality into consideration and will render a Determination.

  Determination

  The following are the only determinations that may be made by the screening officer:

  • affirm the offence notice and set fine.
  • withdrawn the offence notice and set fine.
  • affirm the offence notice and amend/vary the set fine and/or provide extension of time to remit payment.

  *Once the determination is made, you (the appellant) will receive a copy of the determination by e-mail.

• Hearing Process

  • A person may request a review of a Screening Decision, to be conducted by a Hearing Officer within 15 days of screening determination for a Parking-related offence or within 30 days of a Non-parking related offence.
  • A Hearing is conducted virtually by a third-party hearing officer, not affiliated with the Town.
  • Failure to attend at a scheduled Hearing will result in the Penalty Fee imposed from Screening Determination and Administrative Penalties and non-appearance fee.

  On review of a Screening Determination, the Hearing Officer may:

  1. Affirm
  2. Cancel
  3. Vary or extend the time for payment

  Neither a Screening or Hearing Officer has jurisdiction to consider questions relating to the validity of a status, Regulation or By-law or the constitutional applicability or operability of any statute, Regulation or By-law.
