Short Term Accommodation and Bed & Breakfast License Application

This application form is to be used by persons or public bodies wishing to apply for a Short Term Accommodation of Bed & Breakfast Establishment License in the Town of Lincoln. It is recommended that the applicant speak with Town staff prior to submitting a permit application to confirm that the rental meets zoning requirements. If there are any changes to the information provided, the Town shall be notified within 5 business days.

If the Applicant is a corporation, proof that the corporation is a lawfully existing corporation entitled to conduct business in Ontario, which may include a current copy of the articles of incorporation or other incorporating documents, duly certified by the proper government official or department in the Province of Ontario or of the Government of Canada, a certified copy of an annual return which contains a list of all shareholders of the corporations, and/or such other evidence as may be required by the Town.

The name and contact information of a local contact, who shall be an individual, who is no further than thirty (30) minutes away from the STA or B&B who is to be available to address complaints promptly as they arise.

A site sketch depicting the location of the STA or B&B, including setbacks, any proposed storage and refuse area(s), designated driveway(s), and parking location for all spaces intended to be used for parking on the premises in accordance with the Zoning By-law, which is subject to approval by the Director prior to issuing a license.

Where a STA or B&B is intended to host four (4) or fewer guests, a fire safety protocol is required for the Town’s records. Where the STA or B&B is intended to host more than four (4) guests, a fire safety plan is required, which is subject to approval by the Fire Department.

The Town requires proof of insurance for the use of the dwelling unit as a STA or B&B of not less than $2 million, which shall contain an indemnity in favour of the Town from and against claims, demands, losses, costs, damages, actions, suits, or proceedings that arise out of, or are attributable to, the STA’s business and services, which shall be in a form satisfactory to the Town. The insurance cannot be a mix between AirBnB and personal insurance.

Where a property is located in the Niagara Escarpment Commission’s Regulatory Control Area, a development permit authorizing the change in use of a building prior to the issuance of the license, or confirmation from the NEC stating that the proposed use is permitted is required, as applicable. For information purposes, the NEC permits Bed and Breakfast Establishments and Short-Term Accommodations to be located within Single Detached Dwellings as an as of right use.

I acknowledge that all Operators shall adhere to and require guests to comply with parking regulations contained in the Zoning By-law, Town’s Parking By-law, and the approved Site Sketch.
I acknowledge that all Operators shall adhere to and require guests to comply with the submitted Fire Safety Protocol or approved Fire Safety Plan as approved by the Town of Lincoln and posted in the STA and B&B.
I acknowledge that all safety standards for the installation and maintenance of electrical equipment has been done in accordance with the Ontario Electrical Safety Code under the Electricity Act, 1998.
I acknowledge that all Operators shall adhere to and require guests to comply with the identified guestroom and occupancy limits identified on the submitted fire safety protocol or approved fire safety plan as approved by the Town of Lincoln and posted in the STA and B&B.
The Applicant and the Owner of the Short-Term Accommodation premises hereby covenant and agree to release and at all times save harmless and indemnify the Town, its elected officials, officers, employees, servants, agents, successors and assigns (“Town Releases”) from any and all liability, loss, or damage of any nature, including but not limited to property damage, personal injury, or death, all actions, causes of actions, claims and demands whatsoever which may be brought against or made upon the Town or the Town Releases, and against all loss, liability, judgements, costs or expenses, including legal fees, which the Town or the Town Releases may sustain, incur or be put to resulting from or arising out of any act or omission on the part of the Applicant or the Owner of the Short-Term Accommodation premises, or those for whom they may at law be responsible for, in relation to the operation of the Short-Term Accommodation.
I acknowledge that the property contains a functioning septic system in working order, which meets the standards within the Region of Niagara and Part 8 of the Ontario Building Code.

Declarations & Authorizations 

The following sections include several declarations and authorizations that must be confirmed and signed by the owner of the subject land to which this application applies.

I/we make oath and say (or solemnly declare) that the information contained in this application is true and accurate, the information contains in the documents that accompany this application is true and that the owner as of the day on which this application is made has unconditional ownership of the subject land and has disclosed any agreements of encumbrances that apply to the subject lands. I/we make this solemn declaration conscientiously believing it to be true and know that it is of the same force and effect as if made under oath and by virtue of the Canada Evidence Act.
I/we hereby authorize Town of Lincoln staff and/or the Region of Niagara staff and/or the Niagara Peninsula Conservation Authority staff and/or Niagara Escarpment Commission staff to enter onto the subject lands for the limited purposes of evaluating the merits of this application.
