OMB Holds Up Town of Lincoln Position
Shire Development Turned Down

May 19, 2016 – The Ontario Municipal Board has dismissed the appeals by Shire Corporation, thereby refusing the applications to amend the Town of Lincoln Official Plan and Zoning By-law.

Shire Corporation had applied to amend the Town of Lincoln Official Plan and Zoning By-law to permit the storage and distribution of Non-Agricultural Source Material (NASM) at 3289 Frost Road in the Town of Lincoln.

In its decision dismissing the appeals, the Ontario Municipal Board listed the following reasons for dismissing the appeal:

  • The applications do not conform to the Official Plan of the Town;
  • The development does not constitute good land use planning as it fails to have appropriate regard for the protection of agricultural resources of the Province;
  • The use is inconsistent with the Provincial Policy Statement as it is not an agriculture-related use;
  • The use does not conform to the Regional Official Plan;
  • There is no demonstrated need or desirability of the development proposal for the subject lands;
  • No alternative sites were considered; and
  • The lands ought to be preserved for long-term agricultural use.

“This is a good result, not only this particular case and for our community, but for cases coming forward that will hinge on the planning polices of the Province, Town and the Region,” said Mayor Sandra Easton.

“The long standing commitment of the community to defend this case played a significant role in this result and needs to be recognized as does all the work by staff and our entire team,” added Lincoln CAO, Mike Kirkopoulos.

The Town of Lincoln would like to thank all the members of the Lincoln community who took time out of their busy lives to attend the public meeting and the Ontario Municipal Board Hearing to voice their opposition to the proposed development.
