Commissioners for taking Affidavits

 

In accordance with the Commissioners for taking Affidavits Act, R.S.O. 1990, c. C.17, the Clerk and Deputy Clerk of the Town of Lincoln may act as Commissioners for taking Affidavits.  

The Town of Lincoln does not have a Notary Public on staff.  If a document calls for a Notary Public, you will need to seek the assistance of a lawyer (a solicitor that is a member of the Law Society of Upper Canada).

In order to have a document commissioned, all parties required to sign the document must attend the Municipal Offices and must present valid photo identification.

The Clerk or Deputy Clerk will first review the document to determine if the document meets their specifications.  We reserve the right to refuse commissioning services of any document.

If all paperwork is in order: all of the parties named in the document will then subscribe to an oath of truth and the Commissioner will then stamp and seal the document.

There is a fee of $20.00 per commissioned signature for residents of the Town of Lincoln ($25.00 for non-residents).  Payment may be made by cash, cheque or Interac/debit.  Pension documents for seniors and documents under the Vital Statistics Act will be commissioned free of charge.

Please Note: Powers of Attorney, Wills, Estate-related documents and documents that are in any language other than English will not be commissioned.  There will be no exceptions to this policy.
